Chinese challenge to Cfius decision

A bid by a Chinese-owned company to build four small wind farms in Oregon has led to a rare legal challenge to the Committee on Foreign Investment in the US, the powerful and opaque government body that decides on whether takeovers of American businesses have implications for national security.

Two senior lawyers from George W. Bush’s administration have been fighting in court to overturn an order from Cfius blocking construction of the wind farms, which are sited near a US Navy training facility.

The case could set a precedent that curbs the power of the committee, which has been subject to few checks on its authority.
